Kayak Rental and Shuttle Service Agreement
This agreement is made by and between White River Floats, LLC and the undersigned, hereafter referred to as Customer(s).
Kayak Rental Terms and Conditions of Use:
1. ID is required at check-in. The customer who booked the rental must be present at check-in.
2. Customer acknowledges that he/she and any children, if applicable, are skilled enough, strong enough, and experienced enough to participate in this activity.
3. Any questions that the Customer has regarding this activity have been addressed to the satisfaction of the Customer.
4. All White River Floats, LLC kayaks are single person only, we do not offer tandem kayaks at this time and we do not allow lap children; the Lessee agrees not to overload.
5. All safe boating regulations and procedures must be followed. Life jacket/personal flotation device (PFD) will be securely fitted and worn whenever Customer is on the water. Children 12 years of age and younger are required by law to wear a life jacket/flotation device (PDF) at all times while on the water.
6. Glass containers are prohibited on the White River.
7. White River Floats, LLC prohibits the consumption of alcohol or drugs of any kind regardless of the degree of impairment. Customers must refrain from drug or alcohol use prior to or during use of rented equipment.
8. Equipment must be returned on time; there is no grace period for late returns. Early returns will be charged full rental rate; rentals are not prorated.
9. No one under 18 is allowed to rent kayaks. All minors must be accompanied by an adult. Children must be 5 years age and older to float and able to operate their own kayak as we do not allow lap children. We do offer youth kayaks and paddles.
10. Only signatories of the Rental Agreement and Release Forms are allowed to use White River Floats, LLC equipment. Customer is responsible for loss or damage caused by other users.
11. White River Floats, LLC reserves the right to cancel rentals due to inclement weather, high winds, heavy currents, or unforeseen circumstances. A refund or rain check will be given, to be used within the same year.
12. If a customer makes a reservation but does not show they will be charged the full price of the rental without the option of a refund. A no-show is defined as someone who does not arrive or communicate with us (via call, email or text message) within one hour of the starting float time.
13. Customers may not use kayaks or rented equipment for any use not intended by the manufacturers. In addition, customers may not use the kayak for: any illegal purpose or in an illegal manner; in a reckless, abusive, or negligent manner.
14. Anytime you leave your kayak be sure to bring your kayak and paddle fully onto shore.
15. White River Floats, LLC is not responsible for any personal items you bring on the water.
16. White River Floats, LLC does not allow pets or emotional support animals on board any of our kayaks. Only service animals, as defined by the Americans with Disabilities Act (ADA), are permitted. For safety reasons, all service animals must wear a properly fitted canine life vest while on board. Guests are responsible for providing their service animal's life vest, as we do not supply them. If a service animal does not have a life vest, they will not be allowed on the kayak. At White River Floats, LLC safety is our top priority. Our kayaks have strict weight limits to ensure stability and a safe experience for all guests. If the combined weight of human passengers, gear, service animals and anything else on board exceeds the maximum weight capacity of the kayak, we will be unable to accommodate the booking. This policy is not a restriction on service animals but a necessary safety measure to prevent capsizing and ensure a secure experience for everyone on board. We encourage guests to review weight limits in advance and reach out with any questions so we can help find the best solution for their needs. For the safety of all guests and to ensure a smooth paddling experience, service animals must be under control at all times and must not pose a safety risk to the operator, other guests, or the stability of the kayak. If the presence of a service animal is determined to create an unsafe condition, we reserve the right to assess the situation and take appropriate action to maintain safety on the water.
17. We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after changes are made constitutes acceptance of the new Terms.
18. In Case of emergency, call 911.
Customer acknowledges that the estimated replacement value of items rented is up to $1000 for each kayak, paddle, dry box and life jacket.
By signing this agreement, Customer agrees that the credit card on file may be charged for any accrued fees.

Kayak Rental and Shuttle Service Agreement
Fees for Violation of Terms & Conditions:
1. There is a $25/hour late charge, which is payable for any time over five minutes into the hour.
2. Any lost or stolen gear will be charged to the credit card on file; the charge will reflect the full cost of replacement and may include surcharges for any necessary rush orders.
3. Customer acknowledges that White River Floats, LLC has their approval to charge credit card on file for damages, loss, and fines resulting from their use of the kayaks and/or equipment. Customer agrees to comply with all White River Floats, LLC Rental Terms and Conditions, and to pay any applicable fees, as included below.
4. Customers will be charged the full actual cost of any damaged parts on all kayaks and associated gear.
5. Customers will be charged a $50 replacement fee for damaged PFDs; we cannot repair damaged life jackets.
6. If any item cannot be satisfactorily repaired, Customers will be charged the full replacement cost of the item.
7. Any and all loss or damage to the equipment that is caused as a result of the Customer’s operation or oversight is the sole responsibility of the Customer. Do not leave any rental equipment unattended.
8. Customer is responsible for being aware of currents, winds, boat traffic and weather predictions.
9. Any Search & Rescue operations or extractions (emergency or otherwise) are at the sole expense of the Customer.
10. Any damage or loss of equipment due to a Search & Rescue operation or extraction is the sole responsibility of the Customer.
• In no event shall the customer sub-lease boats or gear to another person or entity. The Customers’ rights under this agreement are non-transferable.
• If any provision of this agreement is found to be void, invalid, or unenforceable, such finding shall not affect the validity or enforceability of any other part of this agreement.
• This agreement constitutes the entire understanding of the parties with respect to the subject matter contained herein and shall supersede all other agreements, either oral or written, with respect to the same. This agreement is binding upon the heirs, successors, and assigns of the parties.
